These Terms of Service apply to your use of the Spacetek website and to purchases made from Spacetek Group Pty Ltd through this website.

In these Terms, “Spacetek”, “we”, “us” and “our” means Spacetek Group Pty Ltd ABN 87692636918. “You” and “your” means the customer, user or visitor using our website or purchasing products from us.

1. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights, guarantees, remedies or protections you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

If a product or service supplied by Spacetek fails to meet a consumer guarantee, you may be entitled to a repair, replacement, refund, cancellation, compensation or other remedy as required by law.

If there is any inconsistency between these Terms and your non-excludable rights under the Australian Consumer Law, your Australian Consumer Law rights will apply to the extent of the inconsistency.

2. Website Use

By accessing or using this website, placing an order, or purchasing products from Spacetek, you agree to be bound by these Terms, together with our Refunds, Returns & Consumer Guarantees Policy, Shipping & Delivery Policy, Privacy Policy and any other policies linked on our website.

You must not use this website for any unlawful, fraudulent, abusive, misleading or harmful purpose, or in any way that could damage the website, interfere with other users, or breach any applicable law.

3. Product Information

We aim to ensure that product descriptions, compatibility information, pricing, images, stock availability, shipping information and other website content are accurate and up to date. However, errors, omissions or delays may occur.

Images are for general guidance only. Colours, finishes, dimensions, packaging and included accessories may vary slightly from images or descriptions, provided the product still meets its description and any applicable consumer guarantees.

Compatibility guidance is provided to help customers choose suitable products. You are responsible for checking your Starlink model, installation location, vehicle, roof type, power requirements and other relevant details before purchase. If you are unsure, please contact us before ordering.

Nothing in this section limits any rights you may have if a product does not match its description, is not fit for a disclosed purpose, or otherwise fails to meet a consumer guarantee.

4. Orders and Acceptance

When you place an order, you are making an offer to purchase the products in that order. An order is not accepted until we confirm acceptance, process payment, or dispatch the order.

- We may refuse, cancel or limit an order where reasonably necessary, including where:

- a product is unavailable or discontinued;

- there is an obvious pricing, product, stock or shipping error;

- the order appears fraudulent, abusive, automated, commercial/reseller in nature, or inconsistent with fair use;

- payment is declined, reversed or suspected to be unauthorised;

- the shipping address is incomplete, inaccessible, restricted or not serviceable; or

- we are legally required or reasonably entitled to do so.

If we need to cancel or change an order after payment has been received, we will take reasonable steps to notify you using the contact details supplied at checkout. Where an order is cancelled by us, we will refund any amount paid for the cancelled items and any associated shipping charges, unless another lawful arrangement is agreed with you.

5. Pricing, Promotions and Errors

Prices are shown in Australian dollars unless stated otherwise. Prices, promotions and product availability may change without notice before an order is accepted.

If a genuine error affects the price, product description, shipping charge, promotion or availability of a product, we may contact you before dispatch to give you the option to proceed on corrected terms or cancel the affected part of the order for a refund.

We will not use this section to avoid obligations that apply under the Australian Consumer Law.

6. Payment and Account Information

You agree to provide current, complete and accurate billing, shipping and contact information when placing an order. You are responsible for checking that your order details, email address, phone number and delivery address are correct before submitting your order.

Payment must be authorised and received before we dispatch products unless we expressly agree otherwise in writing.

We may use third-party payment providers to process payments. Payment processing is subject to the relevant provider’s terms, security processes and privacy practices.

7. Shipping and Delivery

Shipping, delivery estimates, carrier handling, missing parcels and damaged-in-transit claims are handled under our Shipping & Delivery Policy.

Delivery timeframes are estimates only unless expressly guaranteed in writing. Carrier delays, peak periods, weather, network disruptions, customs processing and other events outside our direct control may affect delivery times.

If your order is delayed, lost, stolen, marked as delivered but not received, or arrives damaged, please contact us promptly so we can assist with reasonable carrier enquiries and any remedy required by law.

8. Refunds, Returns and Consumer Guarantees

Refunds, returns, exchanges, faulty products, change-of-mind returns and return shipping costs are handled under our Refunds, Returns & Consumer Guarantees Policy.

Change-of-mind returns may be subject to conditions, approval, store credit, return shipping costs and restocking/testing fees as set out in that policy.

For faulty, defective, incorrectly supplied or damaged products, Spacetek will provide any remedy required under the Australian Consumer Law. If a product has a major failure, you may choose a refund or replacement. If the problem is minor, we may provide a repair, replacement or refund within a reasonable time.

9. Third-Party Links, Tools and Services

Our website may include links to third-party websites, embedded content, payment tools, review tools, shipping tools, AI chat tools, product videos or other third-party services. These third-party services are provided for convenience and may be subject to their own terms and privacy policies.

We are not responsible for third-party websites, content or services that are not controlled by Spacetek. However, this does not limit any rights you may have against Spacetek for products or services purchased directly from Spacetek.

10. Customer Reviews, Comments and Submissions

If you submit reviews, comments, images, suggestions, feedback or other content to us or through our website, you must ensure that your content is accurate, lawful, not misleading, not defamatory, and does not infringe any third-party rights.

You grant Spacetek permission to use, reproduce, edit and display that content for business purposes, including customer support, product improvement and marketing, unless you tell us otherwise or applicable law requires otherwise.

We may moderate, edit or remove content where we reasonably consider it unlawful, offensive, misleading, irrelevant, spam, abusive, or otherwise inappropriate.

- for any unlawful, fraudulent, misleading, abusive or harmful purpose;

- to infringe intellectual property, privacy, consumer, competition or other legal rights;

13. Starlink and Third-Party Brand Disclaimer

Spacetek is not affiliated with, endorsed by or sponsored by SpaceX, Starlink or the official Starlink Shop. Starlink and related names or marks are used only to identify product compatibility or intended use where relevant.

All support, warranty and consumer guarantee claims for products purchased from Spacetek should be raised directly with Spacetek in the first instance, unless you choose to exercise any rights you may have directly against a manufacturer or another party under applicable law.

14. AI Chatbot and General Information

If our website offers an AI chatbot, automated assistant, product guidance tool or similar feature, the information provided is general assistance only and may be incomplete or inaccurate.

You should verify important product, compatibility, installation, electrical, safety or legal information before relying on it. If you are unsure, please contact us directly before purchasing or installing a product.

Nothing in this section limits any rights you may have under the Australian Consumer Law if a product or service supplied by Spacetek fails to meet a consumer guarantee.

15. Limitation of Liability

To the maximum extent permitted by law, Spacetek is not liable for indirect, incidental, special or consequential loss, loss of profits, loss of revenue, loss of data, business interruption, or similar loss arising from your use of the website or products, except to the extent that liability cannot be excluded under the Australian Consumer Law or another applicable law.

Nothing in these Terms excludes or limits Spacetek’s liability for consumer guarantees, fraud, wilful misconduct, gross negligence, personal injury, or any other liability that cannot lawfully be excluded or limited.

Where liability can lawfully be limited, Spacetek’s liability is limited, at our option and where permitted by law, to resupplying the relevant goods or services, repairing the goods, replacing the goods, refunding the price paid, or paying the cost of resupply, repair or replacement.

16. Customer Indemnity

You agree to indemnify Spacetek for reasonable loss, damage, cost or expense arising from your unlawful conduct, misuse of the website, breach of these Terms, infringement of third-party rights, or information you provide that is false or misleading.

This indemnity does not apply to the extent the loss, damage, cost or expense is caused by Spacetek’s own breach of law, negligence, wilful misconduct, or failure to meet a non-excludable consumer guarantee.

17. Changes to Website, Products and Terms

We may update website content, products, pricing, promotions, policies and these Terms from time to time.

Changes to these Terms apply prospectively from the date they are published on the website, unless otherwise required by law. Changes will not reduce your rights for orders already accepted by Spacetek, unless the change is required by law or you agree to the change.

Your continued use of the website after updated Terms are published means you accept the updated Terms for future use and future purchases.

These Terms are governed by the laws of Australia and, where applicable, the laws of Queensland. You and Spacetek submit to the non-exclusive jurisdiction of the courts of Queensland and the courts of appeal from them.
